Can I Divorce My Thai Spouse While Living Abroad?

Many Thai–foreign couples live in different countries when their marriage breaks down. A common question is whether a foreign spouse can start divorce proceedings in Thailand without currently living in the country.

The answer depends on your marriage registration, nationality, residence, and circumstances of the marriage.

Can I Divorce My Thai Spouse in Thailand?

In some cases, yes.

Thai law contains specific rules for international divorce. Under Thailand's Conflict of Laws Act, the nationality of both spouses can be relevant when determining whether a Thai court can grant a divorce.

If your spouse is Thai, your marriage was registered in Thailand, or you have other significant connections with Thailand, it may be possible to pursue divorce proceedings in Thailand. However, each case must be assessed individually.

What If I Am Living Overseas?

You do not necessarily need to live in Thailand permanently to discuss or pursue a divorce case in Thailand.

Depending on the circumstances, a lawyer in Thailand may be able to assist with the legal process while you remain overseas.

However, practical issues such as:

  • Whether you need to attend court
  • Signing a Power of Attorney
  • Notarisation or certification of documents
  • Service of court documents
  • Evidence located overseas
  • Recognition of the Thai divorce in your country

must be considered before starting the case.

What If My Thai Spouse Does Not Agree?

If your spouse does not agree to the divorce, you may need to file a contested divorce case.

Thai law provides specific grounds for judicial divorce, including adultery, serious misconduct, abandonment, certain forms of separation, failure to provide support, and other statutory grounds under Section 1516 of the Civil and Commercial Code.

What About Children and Property?

If you and your Thai spouse have children or property, the case may involve additional issues such as:

  • Child custody and parental authority
  • Child support
  • Division of marital property
  • Property in Thailand or overseas
  • Bank accounts and investments
  • Recognition and enforcement of the divorce overseas

These matters should be considered before choosing where and how to proceed.

Will the Thai Divorce Be Recognized in My Country?

Not automatically.

Even if you successfully obtain a divorce in Thailand, your home country may have its own requirements for recognizing a foreign divorce.

If you intend to remarry, divide overseas assets, or resolve family matters in another country, it is important to consider recognition requirements before starting the divorce.
